copiers are not illegal unless they directly infringe nintendo's copyright (IE they use a lockout chip designed by nintendo without permission).. How ever the bung case stated that although the device itsself could not be deemed illegal it did promote software theft and hence the judge favoured nintendo and granted an injunction against BUNG exporting to the united states..
